First Conviction Under New Senegal Law
Since March, Senegal’s new legislation has drastically increased criminal and monetary penalties for those charged with same-sex relationships. Recently, a young worker became the first individual to be convicted under these stricter measures.
This legislation comes amid a troubling regional climate, as highlighted in reports analyzing the decline of LGBT rights in Africa in recent years.
Six-Year Sentence in Dakar Court
A court in Dakar has sentenced a young Senegalese man due to his homosexuality, as confirmed by a judicial source. This represents the first conviction following the new law’s enactment in March, which imposes harsher penalties for same-sex relations in Senegal.
According to an undisclosed source, the young man, born in 2002, was apprehended on April 2 in a suburb of Dakar after engaging in a sexual act with another man.
Harsh Penalties and Financial Fines
Last Friday, the Pikine-Guédiawaye court sentenced him to six years in prison for “public indecency” and “unnatural acts,” terms often used to refer to same-sex relationships, during an expedited trial.
He was also fined two million CFA francs, roughly 3,048 euros. The other person involved is reportedly evading capture, the judicial source noted.
Implemented by President Bassirou Diomaye Faye, the law now enforces prison sentences ranging from five to ten years for same-sex relations, with fines between 2 million and 10 million CFA francs.
Rising Arrests in a More Hostile Climate
This legal change comes amid growing homophobia in Senegal, marked by numerous arrests based on suspicions of homosexuality.
The topic has been a recurring part of public debate for years, intensifying particularly after the arrest of 12 men, including two local celebrities, for “unnatural acts” in early February.
Given this context, understanding the challenges faced by sexual minorities in the area becomes crucial, as examined in discussions focusing on LGBTQ communities in the Sahel.
Political Gains for the Ruling Party
Since the law’s introduction, 63 individuals have been detained for similar offenses by the Keur Massar gendarmerie, which leads the investigation.
In Senegal, same-sex relationships are largely seen as deviant, and the intensified crackdown has been a politically beneficial initiative for the governing party.
Global Criticism on Human Rights Grounds
Homosexuality is frequently portrayed as a foreign cultural imposition by Western nations.
Meanwhile, the United Nations High Commissioner for Human Rights, Volker Türk, has denounced the law as a breach of basic human rights, urging its prompt revision.
