Alarmingly, this represents the fourth year of backsliding.

Evaluation Based on Key Indicators
The study assesses all 50 states by evaluating five essential factors: legal protections, family support, political and religious attitudes, healthcare access, and workplace conditions, giving each a score out of 100 to determine its inclusivity for LGBTQ+ individuals.
The 2026 rankings feature Arkansas, Tennessee, Idaho, South Carolina, and Florida as states with the lowest scores.
Deepening Polarization
While certain states bolster their inclusive policies, others enact laws that restrict LGBTQ+ rights. This trend is mirrored federally, evident in some decisions made during the Trump administration regarding LGBTQ+ content and resources.
“The gap between states that are inclusive and those that are hostile is wider than ever, with no sign of closing,” states Todd Sears, CEO of Out Leadership, in the report’s opening remarks.
Polarization is clear in the wave of laws targeting transgender rights, particularly affecting gender identity recognition and trans people’s administrative rights.
Data from the American Civil Liberties Union (ACLU) indicates that over 530 bills deemed anti-LGBTQ+ have been introduced in state legislatures since 2026 began.
This trend is part of a broader rise in anti-LGBTQ+ rhetoric in American politics.
Florida Leading Conservative Shifts
Among the states with the lowest rankings, Florida stands out, marked by various LGBTQ+ topic restrictions in schools.
Governor Ron DeSantis has enacted reforms limiting discussions on sexual orientation and gender identity in educational environments, while also restricting certain health care services for transgender youth and limiting drag performances.
Similar policies have surfaced in Tennessee, Arkansas, and several other Southern and Midwestern states.
Business Challenges Escalate
The report further delves into the economic impact of these developments, aiding businesses in assessing the risks of operating in certain regions.
Authors stress that employers face increased difficulties in recruiting, retaining, or relocating LGBTQ+ employees in states with limited legal protections.
“International companies risk operational and reputational challenges by operating in areas where the legal and social climate hinders LGBTQ+ individuals from living openly,” the document warns.
This scenario now influences decisions regarding investments, office locations, and recruitment strategies for numerous major U.S. companies.
Adapting the Index for New Realities
Reflecting the swift changes in U.S. legislation, Out Leadership has this year expanded its index’s scope.
The criteria now encompass issues such as gender identity-based restroom access, school library book bans, drag show regulations, and government data collection practices relating to the LGBTQ+ community.
“Without these updates, the index would represent a country that no longer exists,” the authors note.
Top States Move Forward
Meanwhile, many states continue to reinforce inclusion, with Massachusetts leading the way, followed by New York, Connecticut, New Jersey, and Illinois. These areas have consistently topped the index over its eight-year history.
Their strong positioning stems from robust anti-discrimination laws, protections for transgender individuals, improved access to inclusive healthcare, and supportive measures for LGBTQ+ families.
